Battery Energy Storage Systems
Battery Energy Storage Systems (BESS) are electrochemical devices that charge or collect energy from the electrical grid or a distributed generation system (e.g., power plant) and then discharge that energy at a later time to provide electricity or other electrical grid services when needed. BESS facilities are an emerging land use that require regulation to protect the community's public health, safety, and welfare. Currently, BESS facilities are not permitted within the Vacaville City limits.
On May 14, 2024 and June 28, 2024, the Vacaville City Council adopted and extended an interim ordinance imposing as an urgency measure a prohibition on the application acceptance, approval, commencement, establishment, operation, relocation, or expansion of grid-scale BESS facilities within the City. The interim ordinance was adopted to promote public health, safety, and welfare, and provide time for City staff to conduct further research and analysis on the potential health and safety impacts of BESS facilities. Since that time, the City of Vacaville Community Development Department has been evaluating BESS facilities for the purpose of creating a new ordinance to regulate new BESS facilities within City limits.
Draft Ordinance Available
On November 7, 2025, the Community Development Department published a draft ordinance for regulating BESS facilities in the City of Vacaville. The draft ordinance was circulated for public review until December 22, 2025. After receiving feedback from the Planning Commission, City Council, and the public, staff revised the ordinance and published an updated version on January 14, 2026.
