Pursuant to the State of California Assembly Bill 2533, the City of Vacaville abides by State requirements regarding the permitting of Accessory Dwelling Units (ADUs) or Junior Accessory Dwelling Units (JADUs) constructed before January 1, 2020, without a permit.

Compliance with Health and Safety Code
The City of Vacaville cannot deny a permit for an unpermitted ADU or JADU that was constructed before January 1, 2020, except when the ADU or JADU does not comply with standards specified in Section 17920.3 of the Health and Safety Code (HSC) that would deem a building substandard
- A checklist list of conditions specified in Section 17920.3 of the Health and Safety Code may be found in the AB 2533 Notice and Permit Checklist.
- Homeowners may obtain a confidential third-party code inspection from a licensed contractor to determine the unit’s existing condition or potential scope of building improvements before submitting an application for a permit.
- An inspector from the City may inspect the unit for compliance with Health and Safety Code standards and provide recommendations for compliance to obtain a permit.
- The City cannot penalize an applicant for having the unpermitted ADU or JADU.
- Homeowners applying for a permit are not required to pay impact fees or connection or capacity charges except when utility infrastructure is required to comply with Section 17920.3 of the Health and Safety Code.
